Terms and Conditions for Nationwide Produce PLC’s Back to our Roots 2025 Competition

1. THE PROMOTER

The promoter is Nationwide Produce PLC whose registered office is at 164 Lord Street, Southport, Lancashire, PR9 0QA. Nationwide Produce PLC is registered in England under company number 1972264.

2. THE COMPETITION

The title of the competition is Back to Our Roots.

3. HOW TO ENTER

3.1 The competition will run from 00:01 (BST) on 3 February 2025 (the “Opening Date“) to 23:59 (BST) on 28 February 2025 (the “Closing Date“) inclusive.

3.2 All competition entries must be received by the Promoter and the applicant must have received an order confirmation for one (1) or more bags of Potato Lovers (washed or unwashed) from the Promoter by no later than 23:59 (BST) on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

3.3 To enter the competition, contact your dedicated account manager at Nationwide Produce PLC by telephone or email and place an order for one (1) or more bags of Potato Lovers by the Closing Date. Each confirmation of an order of Potato Lovers received by the entrant from the Promoter will be one (1) automatic entry to the competition.

3.4 The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.5 By submitting an order for Potato Lovers and in turn a competition entry, you are agreeing to be bound by these terms and conditions.

3.8 The winner will be chosen at random by the Promoter via the Google random number generator from all valid entries. The decision of the Promoter (acting reasonably) will be final.

4. ELIGIBILITY

4.1 The competition is only open to UK registered companies who are customers of the Promoter, except the Promoter or the partner or their holding or subsidiary companies.

4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.

4.3 The Promoter will not accept competition entries:

4.3.1 from applicants who do not meet the eligibility criteria at condition 4.1;

4.3.2 that are automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);

4.3.3 where the entrant does not pay in full for its order of one (1) or more bags of Potato Lovers before the Closing Date;

4.3.4 where the entrant cancels its order of one (1) or more bags of Potato Lovers before the Closing Date.

4.4 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

5. THE PRIZE

5.1 There is one (1) prize available to be won which is as follows:
The winner of the competition will win two (2) tickets to The Festival at Cheltenham Racecourse in the Final Fence Restaurant on 14 March 2025 including:

  • two (2) Final Fence Restaurant Package tickets at The Festival on 14 March 2025 at Cheltenham Racecourse, United Kingdom. The Final Fence Restaurant Package includes;
      • Club Admission Ticket
      • Official Racecard
      • Table for the Day
      • Morning Coffee & Biscuits
      • Welcome Champagne reception
      • Four course buffet (includes cheeseboard)
      • Complimentary Bar including house wine, beers, spirits and soft drinks (excludes Champagne)
      • Traditional Afternoon Tea
      • TV racing coverage throughout the day
      • Betting Service
      • Hospitality team to ensure the smooth running of your day
      • Views overlooking the racecourse and winning post

5.2 The winner’s prize does not include accommodation, travel, travel insurance, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the sole responsibility of the winner.

5.3 You will be responsible for ensuring that you and any person attending with you are available to travel to the event in question on the event dates specified. The dates cannot be changed.

5.4 Prizes are subject to availability. There is no cash alternative for the prize.

5.5 The prize is not negotiable or transferable.

6. WINNERS

6.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.

6.2 The Promoter will use all reasonable endeavours to contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the entrant’s order.

6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners on its website (https://www.nationwideproduce.com/) for a period of six (6) months from 3 March 2025 (“Announcement Date”).

6.4 If you object to your surname, county and winning entry being published or made available, please contact the Promoter (sales@nationwideproduce.com). In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7. CLAIMING THE PRIZE

7.1 If you are the winner of the prize, you will have three (3) of days from the Announcement Date to claim the prize by responding to either our attempts to contact you as referred to in clause 6.2 above or the announcement email. If you do not claim the prize by this date, your claim will become invalid.

7.2 The prize may not be claimed by a third party on your behalf.

7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within three (3) of days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

8. LIMITATION OF LIABILITY
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS

9.1 The Promoter does not claim any rights of ownership in your competition entry.

9.2 You agree that the Promoter may in their sole discretion, but is not required to, make your entry and any publicity materials available on its website (https://www.nationwideproduce.com/) and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry, publicity materials and any accompanying materials for such purposes.

10. DATA PROTECTION AND PUBLICITY

10.1 The Promoter will only process your personal information as set out in the https://www.nationwideproduce.com/privacy-policy/. See also condition 3 and condition 6.4, with regard to the announcement of winners.

10.2 The winner may be required to participate in post-competition publicity including, but not limited to, interviews and photoshoots.

11. THIRD PARTY PROMOTION
Promotion of this competition by unapproved third parties is strictly prohibited. Any entries linked to unauthorised third party promotions will be invalid.

12. GENERAL

12.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

12.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

12.3 These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
