Terms and Conditions for Nationwide Produce PLC & Les Vergers Boiron Rugby World Cup 2023 Competition

1. THE PROMOTER

The promoter is Nationwide Produce PLC whose registered office is at 164 Lord Street, Southport, Lancashire, PR9 0QA. Nationwide Produce PLC is registered in England under company number 1972264.

2. PARTNERSHIP

The Promoter is working in partnership with Les vergers Boiron whose registered office is at 1 Rue Brillat Savarin, 26300 Châteaunauf-sur-Isère, France. Les vergers Boiron is registered in France under company number 542 015 763.

3. THE COMPETITION

The title of the competition is Nationwide Produce & Les Vergers Boiron’s Rugby Rumble

4. HOW TO ENTER

4.1 The competition will run from 06:00 (BST) on 21 August 2023 (the “Opening Date”) to 23:59 (BST) on 20 September 2023 (the “Closing Date”) inclusive.

4.2 All competition entries must be received by the Promoter and the applicant must have received an order confirmation for one (1) or more boxes of Les Vergers Boiron Ambient Puree from the Promoter by no later than 23:59 (BST) on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

4.3 To enter the competition, contact your dedicated account manager at Nationwide Produce PLC by telephone or email and place an order for one (1) or more boxes of Les Vergers Boiron Ambient Puree by the Closing Date. Each confirmation of an order of Les Vergers Boiron Ambient Puree received by the entrant from the Promoter will be one (1) entry to the competition.

4.4 The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

4.5 By submitting an order for Les Vergers Boiron Ambient Puree, you are agreeing to be bound by these terms and conditions.

4.8 The winner and two runners-up will be chosen at random by the Promoter via the google random number generator from all valid entries. The decision of the Promoter (acting reasonably) will be final.

5. ELIGIBILITY

5.1 The competition is only open to UK registered companies who are customers of the Promoter, except the Promoter or the partner or their holding or subsidiary companies.

5.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.

5.3 The Promoter will not accept competition entries:

5.3.1 from applicants who do not meet the eligibility criteria at condition 5.1;

5.3.2 that are automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);

5.3.3 where the entrant does not pay in full for its order of one (1) or more boxes of Les Vergers Boiron Ambient Puree before the Closing Date;

5.3.4 where the entrant cancels its order of one (1) or more boxes of Les Vergers Boiron Ambient Puree before the Closing Date.

5.4 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

6. THE PRIZE

6.1 There are three (3) prizes available to be won which are as follows:
The winner of the competition will win a trip for two (2) adults to the Rugby World Cup 2023 in France between 5 October 2023 and 7 October 2023, including:

  • two (2) nights stay on a bed and breakfast basis at the Lyon Marriott Hotel Cité Internationale in two (2) rooms;

  • return economy class flights from London Heathrow Airport to Lyon Airport Saint-Exupéry;

  • a private tour and tasting experience at Les vergers Boiron factory; and

  • two (2) Du Manoir hospitality tickets to watch the France vs. Italy fixture on Friday 6 October 2023 at the Rugby World Cup 2023.

The two (2) runners-up of the competition will each win a Nationwide Produce PLC and Les vergers Boiron branded polo shirt in a size of their choice, branded cap and branded water bottle.

6.2 The winner’s prize does not include travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner.

6.3 You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified. The dates cannot be changed.

6.4 Prizes are subject to availability. There is no cash alternative for the prize.

6.5 The prize is not negotiable or transferable. The winner’s account manager must be one (1) of the persons travelling.

7. WINNERS

7.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.

7.2 The Promoter will contact the winner and runners-up personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the entrant’s order.

7.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish name of major prize winners on its website (https://www.nationwideproduce.com/) and via email to its customer database on 21 September 2023 (“Announcement Date”).

7.4 If you object to your name surname being made available, please contact the Promoter (sales@nationwideproduce.com). In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

8. CLAIMING THE PRIZE

8.1 If you are the winner of the prize, you will have three (3) of days from the Announcement Date to claim the prize by responding to the announcement email. If you do not claim the prize by this date, your claim will become invalid.

8.2 The prize may not be claimed by a third party on your behalf.

8.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within three (3) of days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

8.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

9. LIMITATION OF LIABILITY

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or the runners-up or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize(s) except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

10. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS

10.1 The Promoter does not claim any rights of ownership in your competition entry.

10.2 You agree that the Promoter may, but is not required to, make your entry and any publicity materials available on its website (https://www.nationwideproduce.com/) and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry, publicity materials and any accompanying materials for such purposes.

11. DATA PROTECTION AND PUBLICITY

11.1 The Promoter will only process your personal information as set out in the https://www.nationwideproduce.com/privacy-policy/. See also condition 7.3 and condition 7.4, with regard to the announcement of winners.

11.2 The winner may be required to participate in post-competition publicity including, but not limited to, interviews and photoshoots.

12. THIRD PARTY PROMOTION

Promotion of this competition by unapproved third parties is strictly prohibited. Any entries linked to unauthorised third party promotions will be invalid.

13. GENERAL

13.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

13.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

13.3 These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
